Terms of Service
Welcome to CommandOne. These Terms of Service ("Terms") govern your access to and use of the website and services operated by CommandOne ("we," "us," or "our") at commandone.app (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Last updated: March 2025.
1. Description of the Service
CommandOne is a business command center for solo founders. The Service helps you visualize projects, revenue, and opportunities; monitor business health; and prioritize daily actions. We may add, change, or discontinue features from time to time. We will use reasonable efforts to notify you of material changes.
2. Account and Registration
You must create an account to use the Service. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for maintaining the confidentiality of your password and for all activity under your account. You must notify us immediately of any unauthorized use of your account.
3. Acceptable Use
You agree to use the Service only in compliance with these Terms and all applicable laws. You may not:
- Use the Service for any illegal purpose or in violation of any laws.
- Infringe or violate the rights of others (including intellectual property or privacy rights).
- Transmit malware, spam, or other harmful or unauthorized content.
- Attempt to gain unauthorized access to the Service, other accounts, or our systems or networks.
- Interfere with or disrupt the Service or the servers or networks that provide it.
- Reverse engineer, decompile, or attempt to extract source code from the Service (except where permitted by law).
- Resell, sublicense, or commercially exploit the Service without our prior written consent.
We may suspend or terminate your access if we reasonably believe you have violated these Terms or abused the Service.
4. Payment and Subscription
Paid plans are billed in advance on a monthly or annual basis as selected by you. You authorize us (or our payment processor) to charge your payment method for all fees incurred. Fees are non-refundable except as required by law or as stated in our refund policy (e.g., we may offer a refund window for annual plans in certain circumstances). We may change fees upon reasonable notice; continued use after a fee increase constitutes acceptance. Free trials, if offered, are subject to the terms stated at signup and may convert to a paid subscription unless you cancel before the trial ends.
5. Cancellation and Termination
You may cancel your subscription at any time from your account settings. Cancellation will take effect at the end of the current billing period; you will retain access until then. We may suspend or terminate your account or access to the Service at any time for breach of these Terms, non-payment, or for any other reason with notice where practicable. Upon termination, your right to use the Service ceases. We may delete your data after a reasonable period following termination; you are responsible for exporting any data you need before then.
6. Your Data and Privacy
You retain ownership of the content and data you submit to the Service ("Your Data"). You grant us a limited license to use, store, and process Your Data as necessary to provide, improve, and secure the Service. Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms. You represent that you have the right to provide Your Data and that it does not violate any third-party rights or applicable law.
7. Intellectual Property
The Service, including its design, features, code, text, graphics, and branding, is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your internal business use in accordance with these Terms. You may not copy, modify, distribute, or create derivative works of the Service without our prior written consent.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. THE SERVICE IS A TOOL TO HELP YOU ORGANIZE AND PRIORITIZE; WE DO NOT GUARANTEE ANY PARTICULAR BUSINESS OR FINANCIAL OUTCOME.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL COMMANDONE, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL) ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM (OR ONE HUNDRED U.S. DOLLARS IF GREATER). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES; IN SUCH CASES, THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
10. Indemnification
You agree to indemnify, defend, and hold harmless CommandOne and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Service, (b) Your Data, (c) your violation of these Terms or any law, or (d) your violation of any third-party rights.
11. Changes to the Terms
We may modify these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. If changes are material, we will notify you by email or through the Service. Your continued use of the Service after the effective date of changes constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Service and may cancel your account.
12. General
- Governing law: these Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict of law principles.
- Disputes: any dispute arising out of or related to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.
- Entire agreement: these Terms, together with the Privacy Policy and any order or plan terms, constitute the entire agreement between you and CommandOne regarding the Service.
- Severability: if any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect.
- Waiver: our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
